Owners of an exclusive Knightsbridge restaurant called Zuma have won a High Court battle against a businesswoman who used the same name for her dog food business.
Zuma has been a hot favourite with celebrity diners since 2002 and is rated by many as London's finest Japanese eatery.
Its owners, Azumi Limited, went to the High Court after entrepreneur Zoe Vanderbilt set up Zuma's Choice Pet Products Ltd in 2014.
Miss Vanderbilt said she had named her company after her beloved pet, Zuma, a Japanese Akita/German Shepherd cross.
But the restaurant's chef and co-founder, Rainer Becker, was left fuming by the association with dog food.
Judge Melissa Clarke has ordered Ms Vanderbilt to stop breaching the restaurant's trade marks. She will not have to change the name of her company but, other than that, cannot use the word Zuma to sell pet food anywhere in Europe.
Since opening, Zuma has consistently ranked among London's best restaurants and its turnover in 2015 was £14million. By contrast the turnover of Kingston upon Thames-based Zuma's Choice Pet Products remained at zero, the court was told.
During a meeting with Mr Becker in May 2015 Ms Vanderbilt offered to sell him the business and internet domain name for £500,000.
Ms Vanderbilt said the value of her brand “could be higher than that, given that the pet food market in the UK is, she believes, worth £2 billion per year.”
Simon Malynicz QC, for Azumi Ltd, savaged Ms Vanderbilt over her company's website, dineinwithzuma.com.
“One does not normally refer to dogs dining,” the barrister said, “dogs eat, they do not dine.”
The court heard Ms Vanderbilt's dog foods bear the names of 'slow braised pork', 'cottage pie with cheesy mash' and 'chicken and lentils'.
The judge found that Azumi's Ltd's bid to make Ms Vanderbilt change the name of her company had been unjustified.
But, issuing an injunction against her, she found her use of dineinwithzuma.com, ZUMA and DINE IN WITH ZUMA all infringed the restaurant's trade marks.

Emily Davies followed in the footsteps of her father Karl when she left university, embarking on a career in the pet industry. So it was no surprise they were both working at PATS Sandown although it was on different stands.
Emily was on the Little BigPaw stand in the Esher Hall while Karl was looking after things on the Ferplast stand in the Surrey Hall upstairs.
“I’ve got a lot to thank Dad for,” said Emily, who is Sales & PR Manager at Little BigPaw. “He actually helped me to get this job.
“I was made redundant just four weeks before taking the keys to my first house, and you can imagine it wasn’t a particularly nice time to be out of work.
“But Dad made a few calls, one of which was to Jim Weston at Little BigPaw, and thankfully I managed to secure a job with this great new company.”
Karl has worked in the pet industry for 30 years, 23 of which have been at Ferplast, and he knows a lot of people in the trade.
“I did what any Dad would do if their son or daughter suddenly lost their job, and that was to ring around a few contacts. The first call was actually to Jim Weston, who said Emily should get in touch. Getting the job was actually down to her.
“I’m very proud of what she has achieved and it’s good to be able to talk to your only child about the pet industry.”
Emily, who has also worked at Fish4Dogs in the past, said her father wasn’t always keen to have her around, joking: “It’s my life’s mission to embarrass him.”
But they agreed that PATS Sandown had been a great show for both their companies.

GA Pet Food Partners experienced another fantastic PATS show at Sandown Park with lots of interest being shown in the company's Grain Free products.
"Although we did speak to a lot of new potential customers we are finding more and more that PATS for us is about seeing our existing customers who were very much interested in all our new Grain Free products," said Georgina Sims-Stirling.
"GA took the full Southern sales team, so all the customers were able to speak directly to their account manager.

Beco Pets has announced its first venture into television by sponsoring a new prime-time entertainment series, ‘The Great British Bark Off’.
The Saturday night game show, airing later this year, stars canine contestants in the kitchen and will feature dog-themed dishes for pet-loving family audiences.
Host of TV’s quiz ‘A Question of Sport’, aptly-named Sue Barker (pictured above) is tipped to replace judge Mary Berry as host of ‘Bark Off’.
An insider at the BBC (British Barking Corporation) leaked plans for the show, which revealed dogs are being trained to take on a range of cooking challenges.
Dishes for dogs to cook include salmon and cream cheese beagles and ruff-puff pastry. An agility expert from Crufts has also been brought in to improve contestants’ sausage dogs rolls. Producers insist health and safety are key during filming in case any studio dishes catch fire and go woof in the ovens. For protection, dogs will have to wear chefs’ hats.
Beco Pets is proudly sponsoring the show’s savoury section, and the restaurant chain Wagger-Mama will fund a sweets section with dishes planned like poodle strudel and jam scones with whippet cream.
Beco Pets co-Founder George Bramble said: “We’ve longed for ages to sink our teeth into a project like this. Now we’re positively salivating at the prospect of making our debut as TV sponsors. This is a first for us, but as dog owners ourselves, we know how to take the lead.”
Beco partner Toby Massey added: “During filming, it’s been agreed contestants will be fed our healthy new meat-meal free Beco Food for Dogs recipes (wild boar, free-range chicken and sustainably caught fish) to keep their strength up.”
This weekend, rehearsals took place for a pilot episode featuring two Beco office dogs: Terrier Rupert, (pictured, top, with Sue, no relation to the TV presenter) and Tarka the Labrador (above) who helped Sue measuring ingredients.
Asked whether the Great British Bark Off is ever likely to be broadcast, one senior TV Commissioning Centre executive said: “With dogs as the stars, this show’s clearly got legs.
“That’s why we’ve invested heavily in it. The baking format’s a bit old and crusty though and we just hope we haven’t been sold a pup.”

Pets at Home has said that it will not be selling rabbits over Easter, in an attempt to crack down on impulse buying which leads to dozens of animals being abandoned each year when the novelty value wears off....
Pets at Home has said that it will not be selling rabbits over Easter, in an attempt to crack down on impulse buying which leads to dozens of animals being abandoned each year when the novelty value wears off.
The retail chain said customers will not be able to buy or adopt a rabbit at any of its stores during the period between Good Friday and Easter Monday.
Customers’ interest in rabbits increases at Easter due to the holiday’s connection with the Easter bunny, according to the retailer.
But Pets At Home said many children do not understand the specific needs of rabbits, which means that many are left abandoned once the Easter period is over.
“We pride ourselves on putting pets before profit so we’ve taken the decision not to sell rabbits during the upcoming Easter weekend. Nor will customers be able to adopt rabbits in need of rehoming from our in-store adoption centres,” said Peter Pritchard, chief executive of retail at Pets at Home.
“Our informative workshops help families understand what’s involved in being a responsible rabbit owner,” Mr Pritchard added.
UK-wide figures from the Rabbit Welfare Association & Fund (RWAF) from 2012 found that around 67,000 rabbits were given to shelters each year.
Other retailers including Pets Corner and Jollyes have also pledged to suspend rabbit sales over the Easter period, according to RWAF.

Dog owners alerted to thyroid cancer risk in pet food
The US Food and Drug Administration is advising pet owners and caretakers, veterinarians, and the pet food industry to be aware that pet food and treats made with livestock gullets (meat from the throat region) have the potential to contain thyroid tissue and thyroid hormones.
The US Food and Drug Administration is advising pet owners and caretakers, veterinarians, and the pet food industry to be aware that pet food and treats made with livestock gullets (meat from the throat region) have the potential to contain thyroid tissue and thyroid hormones.
Pets that eat food or treats containing thyroid hormones may develop hyperthyroidism, a disease that is rare in dogs and usually triggered by thyroid cancer.
Symptoms of hyperthyroidism include excessive thirst and urination, weight loss, increased appetite, restlessness, hyperactivity, elevated heart rate, rapid and/or labored breathing, vomiting, and diarrhea. Continued exposure to excess thyroid hormones can cause damage to the heart and in some cases, death.
The FDA is issuing this alert now after a recent Centre for Veterinary Medicine investigation into reports of three dogs in different households that showed signs of hyperthyroidism.
In these cases, extensive testing on all three dogs conducted at a reference laboratory showed elevated thyroid hormone in the blood, but ruled out thyroid cancer. Reference lab interviews with the dogs’ owners revealed that all three dogs had been fed BLUE Wilderness® Rocky Mountain Recipe TM Red Meat Dinner Wet Food for Adult Dogs and/or Wellness 95% Beef Topper for Dogs.
Based on the recommendation of the reference lab’s consulting veterinarian, the feeding of these dog foods was discontinued. After the dogs stopped eating these products for a few weeks, their clinical signs disappeared and thyroid hormone levels returned to normal.
An FDA lab tested unopened cans of BLUE Wilderness® Rocky Mountain Recipe TM Red Meat Dinner Wet Food for Adult Dogs and Wellness 95% Beef Topper for Dogs and confirmed that they contained active thyroid hormone. The source of thyroid hormones is likely from the use of gullets from which the thyroid glands were not completely removed before adding to pet food or treats.
After consulting with the FDA, both WellPet (the maker of Wellness) and Blue Buffalo (the maker of Blue Wilderness) initiated voluntary recalls of select lots of the affected products on March 17, 2017.
WellPet voluntarily recalled of certain lots of 13.2 ounce cans of Wellness 95% Beef Topper for Dogs with best-by dates of 02 FEB 19, 29 AUG 19, and 30 AUG 19 printed on the bottom of the can. The UPC Code is 076344894506.
Blue Buffalo Company voluntarily recalled of one lot of 12.5-ounce cans BLUE Wilderness® Rocky Mountain Recipe TM Red Meat Dinner Wet Food for Adult Dogs with a best-by date of June 7, 2019 printed on the bottom of the can. The UPC code is 840243101153.
The FDA appreciates the cooperation and swift action taken by both firms to address this issue. If your dog has eaten either of these foods and is showing symptoms of hyperthyroidism, discontinue feeding of these foods and consult your veterinarian, making sure to provide your dog’s dietary history, including what the dog has been eating, how much, and for how long.
Consumers who have any of the recalled food should not feed it to their animals and can refer to the company press releases for further instructions about returns/refunds.
Questions about whether a particular pet food or pet treat product contains livestock gullets and/or thyroid hormones should be directed to the product manufacturer.
The FDA provides more detailed information about the issue of thyroid hormones in pet food in its Letter to Veterinary Professionals and Letter to Industry.

ProtectaPet has donated the showcase dog run, which has a retail value of £8,000 including professional installation, to Manchester Dogs’ Home.

Many of the dogs awaiting adoption cannot be walked off the lead and so this new dog run offers the optimum chance of being able to stretch their legs outside of their pen.
The target market includes dog boarding kennels, dog rescue centres and high intensity specialist dog containment compounds.

Sled-dog racing, Bike-jor, Cani-cross and Scootering – all the excitement of the 2016 IFSS European Dryland Championships was captured on video by CSJ.
Held in Thetford Forest in November 320 racers from all over Europe competed for top honours from the International Federation of Sled Dog Sports.
The dogs taking part ranged from German Pointers to Huskies and several other breeds, including Uno, the Dalmation who competed in the Scooter racing.

When Sophie Tranter from Monmouthshire returned home from work to find her horse had suffered a nasty cut to his leg, she immediately recognised the seriousness of the injury.
Six-year-old Toby had cut his front leg whilst out in the field, resulting in a flap of loose skin over a large wound. Sophie transported Toby straight to her local veterinary practice for treatment, where it was initially decided that the skin flap should be stitched down.
Unfortunately, the stiches didn’t hold in place meaning the skin flap had to be removed leaving the large wound open.
In order for the wound to heal and to prevent infection, Toby, who is a 15.2hh Connemara, would require extensive bandaging with regular dressing changes.
Sophie used several products from the Robinson Animal Healthcare range to dress Toby’s wound and help support his leg during the recovery process.
Activate® wound dressing was placed against the open wound to prevent bacteria entering, followed by Veterinary Gamgee® as a second layer to protect the wound and help control any swelling. Equiwrap® was then placed over the top of the Veterinary Gamgee® as a final layer to hold everything in place.
Due to Toby’s playful nature, the range of products was put to the test, particularly on the two occasions when Sophie, who is a Quality Systems Coordinator for a beverage company, returned home to find he had escaped from his stable to turn himself out in the field, which Toby really enjoyed but resulted in yet another bandage change.
Another extra bandage change was required after Toby completely soaked his bandage after using his water bucket as a foot spa!
Said Sophie: “All the products successfully passed the test. The bandage did not move and everything was securely held in place, even after the occasions he decided to turn himself out.
“I changed the bandage myself and found the products easy to open and handle. The Equiwrap® was brilliant as it stuck to itself really easily and was easy to tear when I needed it to.
“The Activate® wound dressing was by far my favourite product to use as it ensured the wound closed rapidly and I never had a problem during the healing process with infection or bacteria entering the open wound.
“It also never stuck to the wound so when the bandage and dressing was changed, it came away easily which didn’t distress Toby. I would highly recommend products from the Robinson Animal Healthcare range to everyone.”
